OnSeen, LLC and its affiliates (collectively, “OnSeen” or “we”) operates OnSeen.com and affiliated websites (collectively, the “Website”) in order to provide certain specific services to its registered users (the “Services”). This Privacy Policy serves as the agreement between OnSeen and visitors to or users of the Website (collectively, “you” or “Users”), and governs our use of your personal information that we collect from you. The purpose of this Privacy Policy is to inform you how OnSeen may use that information, whether we disclose it to anyone, and the choices you have regarding your information.
VISITOR TRACKING
We do not require site registration to access certain portions of the Website, in which case the only information collected is standard internet information such as cookies and server logs, or any other information you enter on the Website. However, certain information supplied by Users, particularly Users who have registered on the Website, will be used by OnSeen, its affiliates and its vendors to provide you with requested information or Services. OnSeen may share your personal information with its affiliates and vendors, as well as with other Users, for a variety of reasons, including providing Users with better Services, improvement of OnSeen events and Services to Users, research, and fulfilling User’s requests for specific events and Services, such as group or event-specific communications. OnSeen may also use your personal information for such purposes as: maintaining your account; troubleshooting; keeping a history of previous groups and events; collecting fees owed; processing payments; measuring interest in events; updating the Services; customizing your experience; detecting and protecting against errors and problems; protecting OnSeen against fraud and other criminal activity; enforcing the OnSeen Terms of Use; and as otherwise described to you at the time of collection. OnSeen also reserves the right to perform statistical analyses of User behavior in order to measure consumer interest in the various areas of our Website.
REGISTRATION AND VOLUNTEERED INFORMATION
Portions of the Website require that Users give us contact information, such as name, user name, photo, website address, Twitter® and Facebook® accounts, mailing address, mobile phone number (for calls or SMS messages), and e-mail address. Some of this information, such as your name, user name and photo, are listed publicly or in specific events or groups on the Website. If you supply us with your e-mail address or mobile phone number, you may receive periodic messages from OnSeen regarding events and Services, though you may manage the types of messages in your account settings. We may use your contact information to market to you. You may unsubscribe by following the instructions on the Website. You may also modify your information in your account settings.
If you email us, we may keep your message, email address and contact information. If you connect your account to your Twitter® and/or Facebook® (or similar service) accounts in order to cross-post between the Website and that service, the other service may send us your registration and profile information on that service and other information that you authorize.
THE PUBLIC AND OTHER USERS CAN SEE YOUR INFORMATION
OnSeen is, by its nature, very public. Our Services are primarily designed to help you publicly share information with other Users, groups and events. Much of the information you provide to us on the Website is information you are asking us to distribute to other Users, events or groups. This includes your location updates, the Users you follow, the events and groups you subscribe to, and other information that result from your use of the Services. Some location updates can be enabled merely by your mobile device. Certain groups and events may be more private and provide only restricted access (the event or group details will usually indicate any such restrictions). Always be careful when sharing information with a private or public User, group or event. You can manage certain of these functions in your account settings. We may store and use location information to provide the Services and to improve our offerings, including marketing to you in location-specific ways.
SITE SECURITY MEASURES
OnSeen will take reasonable security precautions to keep your personal information confidential, other than as set forth in this Privacy Policy or otherwise in an agreement between us and you, such as the Terms of Use. OnSeen will comply with applicable laws regarding the storage of such personal information.
PAYMENT INFORMATION
Some Users will make payments to us through the Website, such as for specific events, via credit card or other approved electronic payment method. Using a credit card will require additional information from Users, such as a billing address, a credit card number and a credit card expiration date. Other payment methods may require certain tracking information. In order to provide better security, OnSeen will not store your credit card information for future purchases.
THIRD PARTY SERVICE PROVIDERS
OnSeen uses third party service providers to perform functions and provide services to us. Some of those service providers may reside outside of the United States. Those service providers may access your personal information while performing services for us, or we may share your personal information with such service providers subject, but in each case such disclosure will be subject to confidentiality obligations consistent with this Privacy Policy, and on the condition that the service providers use your private personal data only on our behalf and pursuant to our instructions.
OTHER USES OF INFORMATION
OnSeen will share your personal information as required by law or in order to support investigations; prevent or take action regarding illegal or disruptive activities; in response to violations of OnSeen’s Terms of Use; to protect the safety of any person or property; to protect SmartCrowd’s rights or property; and for other reasons in OnSeen’s reasonable discretion. OnSeen may also share your personal information with a third party if OnSeen is acquired by or merged with another company, or enters into negotiations regarding the same. Such information disclosure would be subject to confidentiality restrictions.
AGGREGATED OR NON-PRIVATE DATA
OnSeen may share or disclose your non-private, aggregated or otherwise non-personal information, such as your public User profile information and picture, public messages, the Users you follow or who follow you, or demographic data of groups or events.
CHILDREN’S PRIVACY
The Website and Services are not directed toward children 12 years or younger, and we require our Users to be 13 years old or older. Accordingly, OnSeen does not knowingly collect or maintain personally identifiable information from children 12 years old or younger. If a parent or guardian becomes aware that his or her child has provided any personal information on the Website, he or she should contact us at [email protected]. If we become aware that a child 12 years or younger has provided us with personal information, we will delete it from our files.
PRIVACY POLICY CHANGES
OnSeen may update and change this Privacy Policy from time to time and at any time. OnSeen will notify you about material changes to this Privacy Policy by providing a notice on the Website and/or sending a notice to your mobile phone/computer/email address if you have specified one to us. By continuing to access or use the Services after the changes have become effective, you are agreeing to be bound by such changes. OnSeen encourages all Users to check back at the Website and review this Privacy Policy periodically.
